FREEDOM OF CHOICE (SECTION 81 OF THE INSURANCE ACT)

In case of approval of the loan, you will be required to contract a Decreasing Term Assurance Policy to cover the loan in case of Death and Total and Permanent Disability and a comprehensive motor insurance policy on the vehicle to be given as security.

Please take note that in virtue of section 81 of the Insurance Act 2005, you have the choice:


(1) as whether you wish to enter into a new policy or wish to make available an existing policy;


(2) as to the insurer with which the policy is entered into and/or as to the insurance agent.


You hereby declare that you are freely and willingly exercising that freedom of choice.

Declaration

I confirm that the information given is true, correct and complete and that the Company may duly rely thereon for the processing of my loan application.

I understand that failure to give true and complete answers to all questions may entitle the Company to reject the loan application at its sole discretion.

I declare that I have not withheld any information that will enable The Company to fully assess the adequacy of my repayment capacity.

I understand that the loan facility, if approved, will be governed by the Laws of Mauritius.

I authorise the Company to make any enquiries that it deem necessary in conjunction with this application.

I understand that the Company shall, as part of its appraisal process of the present application have access to MCIB to seek information on credit facilities provided to me by MCIB Participant, and I formally authorise the Company to do so. The present authorization is applicable for all facilities requested now and in the future, until further notice.

I undertake to immediately notify The Company in writing of the particulars of any subsequent credit facility which I obtain from any other lending institution.

Acceptance of Agreement

COMMUNICATION BY MOBILE AND/OR EMAIL

Undertakings

I represent and warrant that the mobile number and/or email address stated above is my mobile phone number
and/or email address on which all binding communication to be received by me or sent out to the Company. Consequently, I will not receive hard copies of my correspondence or documentation;

I represent and warrant that the information supplied is true, correct and complete;

I shall take full responsibility of any instruction, acceptance or undertaking which are issued to and by the Company from and to that email address and/or mobile phone number; 

I shall immediately notify the Company in event that I change mobile phone number and/or email; and I shall at all material times keep restrict use of my mobile phone and/or email address to ensure that no person is able to send any instructions or is able to intercept any communication sent to me. 

I understand that the Company does not protect me from unauthorized use of my email password and/or mobile
phone. I undertake to bear any responsibility in any form whatsoever that may arise due to liability arising from any unauthorized use of my password and/or mobile phone. 

I undertake to hold MUA and/or any of its agents harmless against claims or demands and/or any consequences arising from the execution of the present instruction. I further undertake not to enter any action against the company and hereby irrevocably renounce to any rights I may have in relation to the present instruction. With this registration, I am also entitled to send MUA my supporting documents by e-mail. I understand that my original documents will still
be necessary for customer due diligence, claims or other specific cases.

The present authorisation will remain valid until written revocation by me. 

DATA PROTECTION – CONSENT

1. Data collection, retention and disclosur

I acknowledge, understand and agree that the Company has, for the performance of its obligations hereunder,
collected and where necessary or required, processed and stored personal information which I have voluntarily
disclosed to it (the “Personal Data”) for as long as is necessary to fulfil the purposes for which it was collected,
including for the purposes of satisfying any legal, accounting or reporting requirements.

I understand that the Company has a legal obligation to store basic information about its customers for ten (10)
years after they cease being customers. I understand that the Company undertakes to treat the Personal Data
confidentially and securely in line with the provisions of the Data Protection Act 2017 (“DPA”) and that it
undertakes not to reveal or otherwise disclose the Personal Data to any external body, unless:

(i) it has obtained my express consent;

(ii) it is under either a legal obligation or any other duty to do so; or

(iii) the Personal Data is disclosed to any agent, service provider, professional adviser or any other person under
a duty of confidentiality towards the Company.

2. Transfer outside Mauritius

I expressly acknowledge and agree that the foregoing disclosures may require that the Personal Data be
transferred to parties located in countries which do not offer the same level of data protection as my home
country. Personal Data may be shared amongst affiliated companies and/or subsidiaries of the Company solely
for providing me with information about products that may be of interest to me.
 

3. My Rights

Pursuant to the provisions of the DPA and subject to the payment of a prescribed fee (if any), I acknowledge that
I have, in relation to my Personal Data which is in the custody or control of the Company, the right:
  • to access as well as to request rectification and erasure;
  • to object to the processing; and
  • to withdraw consent at any time, without affecting the lawfulness of processing based on the consent which I had provided prior to my withdrawal.

4. Complaint

I may contact the Data Protection Officer of the Company at DPO@mua.mu. if I wish to exercise any of the aforementioned rights or if I have any queries relating to the processing of my Personal Data. The Company processes Personal Data in accordance with its Data Protection Policy, which can be accessed on www.mua.mu. In the event that I are unsatisfied with the reply provided, I may refer my complaint to the Data Protection Commissioner.
